Terms of Service

1. Acceptance
By creating an account or using Builder Path, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the service.
2. The service
Builder Path is a software platform that helps spec construction lenders identify residential builders in their territory and run personalized outreach campaigns. The platform monitors public records (county recorder, secretary of state, contractor license registries, permits), enriches builder profiles with publicly available business information, and provides tools for the lender's account executives ("AEs") to draft, review, and send outreach from their own connected email inboxes.
Builder Path is not a CRM replacement, a lending platform, or a regulated financial service. We provide intelligence and outreach tooling; loan origination, underwriting, and customer relationships remain with the lender.
3. Eligibility
You may use Builder Path only if you are:
- At least 18 years old
- A licensed lending professional or otherwise authorized representative of a lending organization
- Acting within the lender's subscription seat allocation
4. Your account
- Keep your credentials confidential. You are responsible for activity under your account.
- One AE per seat. Don't share logins.
- Provide accurate profile information (name, NMLS number, lender affiliation).
- Notify us of unauthorized access at [email protected].
5. Acceptable use
You agree not to:
- Send unsolicited bulk email outside the platform's outreach workflow, or use the platform to violate CAN-SPAM, TCPA, or any other anti-spam or marketing law
- Resell or redistribute Builder Path data to third parties
- Scrape or copy the platform's data outside of the export functions provided
- Misrepresent yourself, your lender, or your relationship with builders
- Reverse engineer or attempt to access non-public parts of the platform
- Use the service to harass, defame, or compete unfairly
- Bypass rate limits, security controls, or seat restrictions
Builder data is sourced from public records and intended to support legitimate B2B outreach. You are responsible for ensuring your use of the data complies with applicable laws and your lender's compliance program.
6. Intellectual property
Visionairy owns the Builder Path platform, including software, designs, scoring algorithms, and aggregated builder intelligence. You retain ownership of content you create on the platform — your notes, drafts, signatures, and outreach copy. By creating that content on the platform you grant Visionairy a license to host, process, back up, and operate the platform on your behalf.
Public-record data sourced from third parties (county recorders, state agencies, ATTOM, etc.) remains subject to the source's terms.
7. Outreach compliance
All outreach emails are sent from your connected inbox, under your name, with your business contact information and an unsubscribe option. You are the sender for legal purposes (CAN-SPAM, TCPA, lender compliance). Builder Path provides the tooling — you decide what to send, who to send to, and when. No outreach is auto-sent without your explicit approval.
8. Payment and billing
- Lender organizations are billed via invoices issued by Stripe.
- Accepted payment methods: check, ACH, or credit card.
- Invoices are due net 30 days from issuance unless otherwise agreed in writing.
- Subscriptions are billed monthly per active AE seat at the rate stated in your invoice.
- Late payments may incur a service fee and may result in seat suspension after 60 days past due.
- Pricing is subject to change with at least 30 days' notice; existing invoices honor the rate at issuance.
- No refunds for partial-month cancellations; service continues through the paid period.
9. Termination
You may cancel your subscription at any time by contacting [email protected]. Service continues through the end of your paid period; we don't offer prorated refunds. We may suspend or terminate your access for material breach of these Terms, for unpaid invoices past due, or if continued service would violate the law. On termination you can request export of your account data within 30 days; after that, account-specific data is deactivated and retained only as required for compliance. Builder records remain in the platform per our retention policy.
10. Disclaimers
Builder Path is provided "as is" and "as available". We work to keep data fresh and accurate but we do not warrant that builder records, scores, contact information, or third-party-sourced data are correct, complete, or current. Public records change, enrichment APIs miss matches, and AI-drafted email copy can be wrong. You are responsible for reviewing all outreach before sending. We make no warranty of merchantability, fitness for a particular purpose, or non-infringement, except as required by law.
11. Limitation of liability
To the maximum extent permitted by law, Visionairy's total liability for any claim arising from or related to Builder Path is limited to the amount you paid us for the service in the twelve months preceding the claim. Visionairy is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost loans, or business opportunity, even if advised of the possibility.
12. Indemnification
You agree to indemnify and hold Visionairy harmless from claims, damages, and expenses (including reasonable attorney fees) arising from your use of the platform in violation of these Terms, applicable law, or third-party rights — including outreach you send and lender activity you conduct using Builder Path.
13. Governing law and disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to that jurisdiction.
14. Changes to these terms
We may update these Terms from time to time. When we make material changes we will post the new version here and notify active users by email. Your continued use of Builder Path after the update constitutes acceptance of the new Terms.
